Sean Combs' lawyers have accused the U.S. government of leaking evidence in the extortion and sex trafficking case to the media, including a 2016 hotel surveillance video that shows the disgraced mogul physically attacking singer Cassie Ventura attacks.

According to a court filing Wednesday, obtained by Rolling StoneCombs' legal team is calling for an evidentiary hearing to investigate “government misconduct related to the leaks.” His attorney, Marc Agnifilo, claims that the alleged government leaks “resulted in damaging, highly prejudicial pre-trial publicity that can only weigh on the jury and deprive Mr. Combs of his right to a fair trial.”

Agnifilo called the video from the Intercontinental Hotel in Los Angeles the “most egregious example” of alleged misconduct, but said it was “one in a long and documented history of leaks and false statements with a single goal: the devastation of Mr. Combs' Life” reputation before trial.”

In May, CNN discovered footage of Combs chasing his then-girlfriend Ventura down a hotel hallway, where he then threw, kicked, stomped and dragged her. The violent video was dated March 5, 2016, and appeared to correspond to an alleged incident in a sex trafficking lawsuit that Ventura filed last November.

The surveillance footage prompted Combs to post an apology video on social media two days later. “I take full responsibility for my actions in this video,” he said at the time. “I'm disgusted. I was disgusted then when I did it and I’m still disgusted now.”

In parallel with the evidentiary hearing, Combs' lawyers are calling on government agencies, including the Department of Homeland Security, to disclose emails, documents and records related to the alleged leaks; a gag order prohibiting government employees from releasing case evidence or investigative materials to the media; and the suppression of any leaked evidence during the upcoming trial.

Combs, once a leading and revered figure in the music industry, was charged with conspiracy, sex trafficking and interstate transportation for the purpose of engaging in prostitution. Prosecutors have accused Combs of using his vast wealth and influence to run a criminal enterprise focused on “his own sexual gratification” between 2008 and this year. The charge carries the possibility of life in prison.

He is being held without bail after being arrested on September 16 in New York City. His next hearing is scheduled for Thursday in New York.

The Bad Boy Entertainment founder also faces nearly a dozen civil lawsuits filed against him by multiple women and a man alleging Combs sexually abused them. The alleged attacks date back to 1990 and this summer.
