Menendez brothers could be resentenced after Ryan Murphy series

Lyle and Erik Menendez could soon be released after spending 34 years behind bars for murdering their parents.

Los Angeles County District Attorney George Gascón announced at a news conference Thursday that he would recommend a resentencing of the Menendez brothers, which would allow them immediate parole. “I believe that they have paid their debt to society,” Gascón said.

The bombshell news comes amid renewed interest in the Menendez brothers sparked by two Netflix projects: Ryan Murphy's docudrama series Monsters: The Story of Lyle and Erik Menendezwhich premiered in September, and the streamer's true crime documentary The Menendez brotherswhich landed earlier this month.

Gascón said the brothers' recent treatment has brought “tremendous publicity” to the case. “Frankly, our office has been inundated with requests for information, and although this case was already scheduled to be heard at the end of November, I have decided to move the matter forward because, frankly, we do not have enough resources to process all the requests.”

Koch shared a statement Weekly entertainment celebrate the development. “I am overwhelmed with gratitude and hope for the progress we have seen today. “Gascón’s recommendation has created a new sense of possibility that Lyle and Erik could finally be released after decades behind bars,” he wrote. “I hope to see Erik and Lyle again soon. Free from all of this.”

EW has also reached out to representatives for Murphy and Chavez for comment.

Lyle and Erik Menendez were convicted in 1996 for the 1989 murders of their parents. The brothers were initially tried in separate cases, which resulted in the jury being deadlocked. They were ultimately convicted in a joint case that controversially excluded testimony about sexual abuse by their father. The brothers are currently serving life sentences without the possibility of parole at the Richard J. Donovan Correctional Facility near San Diego.

Gascón explained that because the Menendez brothers were under 26 at the time of the murders and had already served nearly 35 years in prison, they were eligible for immediate parole. However, a judge must first decide whether the brothers should be paroled, and if that happens, their case would also have to be reviewed by a parole board.

Some Menendezes family members held a news conference last week expressing support for a resentencing. “If Lyle and Erik's case were tried today, and given the understanding we now have about abuse and post-traumatic stress disorder, there is no doubt in my mind that their sentencing would have been very different,” said Anamaria Baralt, niece of José Menendez, before the press conference, per ABC.

Shortly after the release of MonsterErik Menendez criticized the series in a statement shared by his wife Tammi on social media. “It is with a heavy heart that I say that I believe that Ryan Murphy cannot be so naive and inaccurate about the facts of our lives as to do this without malicious intent,” he wrote. “Murphy crafts his horrific narrative through vile and appalling character portrayals of Lyle and me, as well as disheartening slanders.”

Murphy responded to Menendez's criticism by defending the series. “The Menendez brothers should send me flowers,” he said. “They haven't received this much attention in 30 years. And it has captured the attention of not only this country but the entire world. There is a kind of exuberant interest in her life and in the case. I know for a fact that a lot of people have offered to help them because my show and what we did was so interesting.
